Terms of Service

1. Agreement

By installing or using Flame Pro DJ ("the app", "Flame Pro DJ", "we", "us") you agree to these Terms. If you don't agree, don't install or use the app. The app is published by moflamepro.com ("we") and sold by Paddle.com Inc. as our merchant of record.

2. License grant

Subject to your payment of the license fee, we grant you a personal, non-exclusive, non-transferable license to use one (1) installation of Flame Pro DJ on one (1) computer at a time. Activation is required to use the app and binds the license to that computer.

You may move the license to a different computer by first deactivating it on the previous one (Settings → Account → Move license to another computer). Sharing your license key, activation token, or activated installation is not permitted.

We may revoke licenses for chargebacks, refunds, or material breach of these Terms. Backups of the installer file are permitted; sharing the activated installation is not.

3. Updates window

Your purchase includes twelve (12) months of feature updates from the date of purchase. After the 12 months end, the version of Flame Pro DJ that you have at that point continues to work indefinitely on the computer where it is activated; you simply do not receive new feature updates unless you renew via the optional Updates Plan.

Bug-fix patches for the version you bought may be released after your 12 months at our discretion and are made available to you at no additional charge.

The Updates Plan is an optional renewal billed at $29 USD/year (subject to change). Cancelling it does not affect your existing installation.

4. Your content

You own the music files you import. We do not claim any rights to them. The app processes them on your machine.

5. Audio handling features

The app has three features whose names contain "clean" or "blur". They behave very differently — we want to be clear about each:

(a) Auto-Clean panel (library cleanup)

This is a metadata tool. It scans for missing files, duplicate tracks, smart-fix tag corrections, genre repair, and similar housekeeping. It does not open, transcribe, or modify any audio file. No copyright concern.

(b) DJ profanity blur (live playback)

When enabled on a deck in the DJ panel, the app mutes the vocals stem at known profanity timestamps during playback. This happens in real time as an audio-routing decision — no modified audio file is created or saved. Public DJ performance is generally covered by your venue's public-performance license (ASCAP, BMI, SESAC, PRS, SOCAN, or your local equivalent) the same way the unblurred track would be.

(c) Future "create clean version" tools (not currently shipped)

The backend contains code that could generate a modified audio file with profanity windows silenced or beeped — a derivative work of the original recording. No feature in the current UI uses it. If a future version of the app exposes such a feature, it will prompt you with a one-time consent dialog summarising the personal-use scope; selling or distributing the modified files would be your responsibility, not ours.

Whatever you do with audio you import into Flame Pro DJ, you are responsible for whether that use complies with copyright law in your jurisdiction. We provide the tools as-is and do not warrant that any output is licensed for any particular use.

6. Streaming integrations

If you connect a streaming service (Spotify, YouTube Music, Tidal, SoundCloud, Deezer, Beatport), your use of that service is governed by that service's terms. The app uses each service's official OAuth flow with read-only scopes. Your OAuth tokens are stored locally on your machine in ~/.music_manager/ with owner-only file permissions; we never see or store them.

The app does not stream, cache, proxy, or download audio from any streaming service. The "Import" function saves only metadata: title, artist, album, BPM, ISRC, duration, and the source service name.

7. AI features

When you use Gig Wizard, smart-fix, translate, Smart Setlist, or any other AI-powered feature, your prompts are sent to the AI provider you configured (Anthropic, OpenAI, Google, or a local Ollama instance). Their terms govern how that data is processed. We do not see or store the prompts.

Third-party lyrics (lyrics.ovh)

The lyrics.ovh integration is disabled by default. If you enable it in Settings → External APIs, the app sends the track's artist + title to the lyrics.ovh public endpoint and displays whatever it returns. lyrics.ovh's licensing relationship with rights holders is unclear; you accept that risk by enabling the toggle. Use lyrics.ovh for personal, private lookup only.

8. Bundled third-party software

Flame Pro DJ ships ffmpeg (GPLv3) and Chromaprint/fpcalc (LGPLv2.1) as separate executable binaries inside the macOS application bundle, plus a portable Python interpreter (Python Software Foundation License) and other permissive-licensed components. Their licenses and notices are reproduced inside the app at Settings → About → Legal & attribution.

The GPLv3 corresponding source for the bundled ffmpeg version is available from ffmpeg.org/releases/ — match the version reported by ffmpeg -version inside the .app. If that link goes stale, contact legal@moflamepro.com for a written-offer source copy.

9. Updates & auto-updater

The app may check for and prompt you to install updates. You can disable update checks in Settings → General. Auto-update downloads happen over HTTPS from a release feed we control.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted or error-free, or that any data processing (including library scans, BPM/key analysis, profanity-window detection, or library cleanup) will be accurate or fit for a particular purpose.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF YOUR USE OF THE APP. Our total liability for any direct damages is limited to the amount you paid for the app in the twelve (12) months before the claim arose.

12. DMCA / intellectual-property claims

If you believe content processed or referenced by the app infringes your copyright, send a DMCA-compliant notice to legal@moflamepro.com. We will respond as required by applicable law.

13. Termination

You may stop using the app at any time and remove your installation. We may terminate or suspend the license if you materially breach these Terms. On termination, you must uninstall and delete the app and any modified copies.

14. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising from these Terms is the state and federal courts located in Wayne County, Michigan, except where mandatory consumer-protection law in your jurisdiction grants you the right to bring action elsewhere.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in release notes and via in-app notice. Continued use of the app after a material change means you accept the updated Terms.
